According to report copyright case was quashed against filmmaker as court didn’t found any evidence of similarity between scripts and insisted criminal proceedings amounted to abuse of process.
According to report Bar and double Bench Chief comprising Justices PS Narasimha and Alok Aradhe observed that the complaint was baseless as it lacked substance and failed to establish even a basic comparison between the two works in question. Considering allegations were vague and unsupported, with no clue which indicates how the film resembled the complainant’s script.
Well case was filled by Umesh Prasad Mehta, who in his petition accused Sujoy Ghosh for copying his script titled Sabak, he also revealed that he shared his script with Ghosh in 2015. Going thought complaint petition a magistrate court in Hazaribagh issued summons in 2018 under provisions of the Copyright Act. Later Sujoy Ghosh approached the Jharkhand High Court and filled quashing petition which was declined by High Court. Later Sujoy Ghosh approached the apex court, where filmmakers learned counsel, Senior Advocate Siddhartha Dave, argued and stated that the complaint is baseless as complaint has not provided any material evidence demonstrating similarity between the scripts and proceedings were a misuse of legal process. After hearing Senior Advocate Siddhartha Dave The Supreme Court got agreed with these submissions, pointing out that both the magistrate’s summoning order and the High Court’s decision showed a lack of proper judicial consideration. It also highlighted that witness statements presented by the complaint did not establish that any part of the script had been copied. After hearing Advocate argument The Supreme Court gave relief to filmmaker by quashing criminal proceedings against him.
